Annex A: Criminal and Security Provisions

1. Purpose and Scope

  1. This Annex establishes procedures for criminal deportation, security cooperation, and the operational framework for TreatyPol's criminal enforcement mandate.
  1. These provisions enable the free movement of persons while maintaining security through effective cooperation rather than preventive restrictions.
  1. All provisions shall be interpreted to preserve both individual rights and national sovereignty.

2. Criminal Deportation Framework

2.1.1 Member nations may deport non-citizens to their nation of citizenship upon:

  • Conviction for a criminal offense punishable by imprisonment of one year or more
  • Violation of immigration status requirements

  • Using fraudulent documentation to obtain entry

2.1.2 Deportation shall not be used for:

  • Political expression or peaceful activism
  • Religious observance
  • Minor administrative violations
  • Discriminatory purposes based on ethnicity, religion, gender, or other protected status

2.2.1 Member nations shall:

  • Provide written notice of deportation grounds
  • Allow reasonable opportunity to contest factual basis
  • Notify nation of citizenship prior to deportation

  • Permit voluntary departure when security permits

2.2.2 Receiving nations shall:

  • Accept their citizens without delay
  • Confirm identity through biometric verification
  • Provide necessary documentation for return
  • Assume responsibility upon arrival
  • Process returned citizens according to domestic law

2.3.1 Humanitarian exceptions may apply when:

  • Individual faces credible risk of torture
  • Medical conditions prevent safe travel
  • Family unity considerations are compelling
  • Statelessness would otherwise result

2.3.2 Such exceptions shall be:

3. Weapons Control

  • Maintain records according to standardized formats

5.1.2 TreatyPol shall:

5.2.1 Member nations shall:

6. TreatyPol Security Coordination

6.1.1 Member nations shall:

  • Share information on cross-border security threats
  • Establish 24/7 points of contact
  • Participate in regular security briefings
  • Contribute to threat assessment processes
  • Implement coordinated countermeasures where appropriate

6.1.2 TreatyPol shall:

  • Facilitate secure information exchange
  • Analyze threat patterns across jurisdictions
  • Coordinate multilateral responses
  • Provide early warning of emerging threats
  • Support member capacity building

6.2.1 Member nations may establish:

7. Amendment Procedure

  1. This Annex may be amended by simple majority vote of the Council of Representatives.
  1. Proposed amendments shall be circulated at least 90 days before voting.
  1. Member nations may submit comments on proposed amendments during the circulation period.
  1. Technical updates to operational procedures may be implemented by TreatyPol with notification to member nations.
